Terms of Use & End User License Agreement

This Terms of Use and End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Exuma Secrets ("we," "our," or "us") governing your use of the Exuma Secrets mobile application (the "App") available on Apple App Store and Google Play Store. By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree, do not use the App.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, strictly in accordance with this Agreement and for your personal, non-commercial use.
2. Restrictions
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the App.
- Reverse-engineer, decompile, or disassemble the App, except as permitted by applicable law.
- Remove, alter, or obscure any proprietary notices within the App.
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to any systems or networks connected to the App.
- Use automated scripts, bots, or scrapers to interact with the App.
- Upload, transmit, or distribute malware, viruses, or other harmful code.
- Circumvent, disable, or interfere with security features of the App.
3. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to notify us immediately of any unauthorized use. You may not share your account credentials with others or create multiple accounts.
4. User-Generated Content
The App allows you to submit content, including community posts, comments, reviews, ratings, photos, trip itineraries, and direct messages ("User Content"). You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your User Content within the App and related services.
You represent and warrant that you have all rights necessary to submit your User Content and that it does not violate any third-party rights, including intellectual property, privacy, or publicity rights.
5. Zero Tolerance Policy for Objectionable Content and Abusive Behavior
Exuma Secrets maintains a strict zero-tolerance policy for objectionable content and abusive users. Any content or behavior that violates this policy will result in immediate removal of the offending content and suspension or permanent termination of the responsible user's account.
You agree not to submit User Content or engage in behavior that:
- Is false, misleading, defamatory, obscene, pornographic, or sexually explicit.
- Contains hate speech, discrimination, or prejudice based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Harasses, threatens, bullies, intimidates, or stalks other users.
- Promotes violence, self-harm, terrorism, or illegal activities.
- Contains graphic or gratuitous violence.
- Infringes any intellectual property or other rights of any third party.
- Contains spam, solicitations, or unauthorized advertising.
- Impersonates any person or entity or misrepresents your affiliation.
- Exploits or endangers minors in any way.
- Violates any applicable law or regulation.
6. Reporting, Blocking, and Content Moderation
The App provides built-in tools to help maintain a safe and respectful community:
- Flagging/Reporting: You may report any objectionable content (posts, comments, reviews, or direct messages) using the report button available on each piece of user-generated content. When reporting, you will be asked to provide a reason for the report.
- Blocking Users: You may block any user whose behavior you find objectionable. Blocking a user will immediately remove all of their content from your feed, prevent them from sending you direct messages, and prevent them from interacting with you. Blocking also sends a notification to our moderation team for review.
- AI-Powered Content Filtering: The App uses artificial intelligence (AI) and automated content filtering to analyze all user-generated content — including community posts, comments, reviews, and direct messages — before publication. Content that is flagged by our AI moderation system as violating community guidelines will be rejected. This system evaluates content for hate speech, harassment, sexually explicit material, threats of violence, spam, and other objectionable content. AI moderation is supplemented by keyword-based filtering for immediate detection of prohibited language.
Our Commitment: We will review all reported content and blocked user notifications within 24 hours of receipt. If the reported content or user behavior is found to violate this Agreement, we will take the following actions:
- Remove the offending content immediately upon confirmation.
- Issue a warning to or suspend the account of the user who provided the offending content.
- For severe or repeated violations, permanently terminate the offending user's account.
We reserve the right to remove or moderate any User Content at our sole discretion without notice.
7. Direct Messaging
The App provides a direct messaging feature that allows users to communicate with business owners and other users. By using direct messaging, you agree to:
- Use messaging only for legitimate inquiries, travel-related discussions, and business communications.
- Not send unsolicited messages, spam, or commercial solicitations.
- Not use messaging to harass, threaten, or engage in abusive behavior toward other users.
- Respect business owners' choice to enable or disable direct messaging.
All direct messages are subject to the same content standards and AI moderation as other User Content. We reserve the right to monitor, review, and remove messages that violate this Agreement.
8. Trip Sharing
The App allows you to share trip itineraries with other registered users. By sharing a trip, you grant the recipient a read-only copy of your trip details. You are responsible for ensuring you only share trips with intended recipients. Recipients may accept or decline shared trips at their discretion.
8A. Friends and Social Connections
The App allows you to connect with other users through a friends system. By using the friends feature, you agree to the following:
- You may send friend requests to other registered users. The recipient may accept or decline the request at their discretion.
- Once a friendship is accepted, both users can see each other's name, username, and profile photo in their friends list.
- Your existing friends may appear as suggestions when composing new messages.
- Either user may unfriend the other at any time, which immediately removes the connection.
- You agree not to use the friends feature to harass, stalk, or spam other users. Abuse of this feature will result in account suspension or termination.
- Push notifications may be sent for friend requests and acceptances. You can manage notification preferences in your device settings.
8B. Usernames and People Search
Each user may choose a unique username that is displayed publicly on community posts, comments, likes, and their profile. Your real name is not displayed on community content. By selecting a username, you agree to the following:
- Usernames must be 3 to 30 characters long and may contain only letters, numbers, and underscores.
- Usernames are unique on a case-insensitive basis (e.g., "JohnDoe" and "johndoe" are treated as the same username).
- You may change your username at any time, subject to availability.
- Usernames must not impersonate other users, public figures, or brands, and must comply with the content standards in Section 5.
The App provides a people search feature that allows users to find other registered users by name, username, or email address. Your email address is used for search matching purposes only and is not displayed in search results.
9. Location Services
The App uses your device's GPS location, with your permission, to enable check-ins at points of interest and to display nearby locations. Location data is used solely for proximity verification (within approximately 500 meters of a point of interest) and is not continuously tracked. You may disable location access at any time through your device settings, though some features may become unavailable.
Location-based features rely on device GPS accuracy, which may vary. We do not guarantee the precision of location data and are not responsible for any inaccuracies.
10. Gamification and Points
The App includes a gamification system with points, badges, explorer levels, and leaderboards. These are provided for entertainment purposes only and have no monetary or real-world value. We reserve the right to modify, reset, or discontinue the gamification system at any time without prior notice.
11. Eligibility and Age Requirements
You must meet the minimum age requirement to use the App:
- United States: You must be at least 13 years of age.
- European Economic Area and United Kingdom: You must be at least 16 years of age (or the applicable minimum age in your member state).
- Canada: You must be at least 13 years of age, or have verifiable parental consent as required by applicable provincial law.
- South Korea: You must be at least 14 years of age.
- All other jurisdictions: You must meet the minimum age required by your local law to enter into a binding agreement, or have parental/guardian consent.
By creating an account, you represent that you meet the applicable age requirement. If we learn that a user does not meet these requirements, we will promptly delete their account and associated data.
12. Premium Subscriptions and In-App Purchases
Certain features of the App may require a paid subscription ("Premium") or one-time in-app purchase. If you purchase a Premium subscription:
- Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscription through your device's account settings (Apple App Store or Google Play Store).
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
- Refunds are subject to the policies of Apple or Google, as applicable.
- Premium features include but are not limited to: ad-free experience, exclusive profile frames, and enhanced customization options.
We reserve the right to change subscription pricing. Any price changes will take effect at the start of the next subscription period following the date of the price change.
12A. Merchandise Purchases
The App includes an in-app merchandise storefront ("Shop") where you may purchase physical goods, including apparel, accessories, and other branded items. By placing an order through the Shop, you agree to the following:
- Pricing and Currency: All merchandise prices are listed in United States Dollars (USD). Prices include the base item cost but do not include shipping, handling, or applicable taxes, which are calculated at checkout.
- Payment Processing: Payments for merchandise are processed securely by Stripe, Inc. ("Stripe"), a third-party payment processor. Your payment card details are collected and processed directly by Stripe and are not stored on our servers. By completing a purchase, you agree to Stripe's Terms of Service and Privacy Policy.
- Order Fulfillment: Merchandise orders are fulfilled by Printful, Inc. ("Printful"), a third-party print-on-demand and fulfillment service. Once your order is placed, Printful manufactures and ships your items directly to you. We share your shipping name, shipping address, and order details with Printful solely for the purpose of fulfilling your order. Printful's handling of your data is governed by Printful's Privacy Policy.
- Shipping: Shipping times and costs vary depending on the product, shipping method, and destination. Estimated delivery times are provided at checkout but are not guaranteed. We are not responsible for delays caused by carriers, customs, or other factors outside our control.
- Order Confirmation: Upon completing a purchase, you will receive an order confirmation email at the email address associated with your account. Additional email notifications may be sent regarding order status updates, shipping confirmation, and delivery tracking.
- Returns and Refunds: Due to the print-on-demand nature of our merchandise, we generally cannot accept returns or issue refunds for change-of-mind purchases. However, if you receive a defective, damaged, or incorrect item, please contact us at support@exumasecrets.com within 14 days of delivery with photos of the issue, and we will arrange a replacement or refund at our discretion. Refunds, when issued, will be processed to the original payment method via Stripe.
- Product Availability: All merchandise is subject to availability. We reserve the right to discontinue any product, modify product designs, or change pricing at any time without prior notice.
Merchandise purchases are separate from and in addition to any in-app subscriptions or purchases described in Section 12. Subscription cancellation does not affect merchandise orders, and merchandise purchases do not include access to Premium subscription features.
13. Business Listings and Claims
The App allows business owners and property managers to submit and manage listings. By submitting a listing, you represent that you are the authorized owner, operator, or representative of the business or property. We reserve the right to verify listing claims and to remove or modify listings that are inaccurate, misleading, or in violation of this Agreement. Listing information is provided for informational purposes and we do not guarantee its accuracy.
14. Third-Party Services and Links
The App may contain links to third-party websites and services, including booking platforms (such as VRBO, Airbnb, Expedia, and OpenTable), social media pages, payment processors (RevenueCat, Apple In-App Purchase, Google Play Billing, Stripe), merchandise fulfillment services (Printful), and external business websites. These links are provided for your convenience only. We do not control, endorse, or assume responsibility for the content, products, or services offered by third parties. Your interactions with third-party services are governed by their own terms and privacy policies.
15. Intellectual Property
The App and its original content (excluding User Content), features, and functionality are owned by Exuma Secrets and are protected by copyright, trademark, and other intellectual property laws. The Exuma Secrets name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks. You may not use them without our prior written permission.
16. Disclaimers
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The App will function uninterrupted, securely, or error-free.
- Information about points of interest, businesses, weather, tides, or marine conditions is accurate, complete, or current.
- GPS check-in verification will be available or accurate at all times.
- Any defects or errors will be corrected.
- The App will be compatible with all devices or operating systems.
You use the App at your own risk. Any travel, dining, boating, or activity decisions you make based on information in the App are your sole responsibility. Always exercise appropriate caution and judgment when visiting locations, especially water-based activities.
17. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Exuma Secrets, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the App.
- Any conduct or content of any third party on the App.
- Any User Content submitted by you or other users.
- Unauthorized access, use, or alteration of your information.
- Any third-party booking, transaction, or service accessed through the App.
18. Indemnification
You agree to indemnify, defend, and hold harmless Exuma Secrets and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the App, your User Content, or your violation of this Agreement.
19. Account Deletion
You may delete your account at any time directly within the App from your Profile settings, or by contacting us at support@exumasecrets.com. Upon account deletion:
- Your personal data will be deleted or anonymized within 30 days.
- Your User Content (posts, comments, reviews) may be retained in anonymized form.
- Any active subscriptions must be cancelled separately through your device's app store.
- Deletion is permanent and cannot be undone.
20. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach this Agreement. Upon termination, your right to use the App will immediately cease. Sections that by their nature should survive termination will remain in effect, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
21. Changes to This Agreement
We reserve the right to modify this Agreement at any time. We will notify users of material changes by posting the updated Agreement within the App or on our website and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Agreement.
22. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of The Bahamas, without regard to its conflict of law provisions.
However, nothing in this Agreement shall deprive you of the protection of mandatory consumer protection laws in your country of residence. In particular:
- European Economic Area and United Kingdom: If you are a consumer in the EEA or UK, you retain any mandatory rights under EU consumer protection directives and local implementing legislation (including the Consumer Rights Directive 2011/83/EU). You may bring legal proceedings in the courts of your country of residence.
- Canada: If you are a consumer in Canada, you retain any mandatory rights under applicable federal and provincial consumer protection legislation. You may bring legal proceedings in the courts of your province of residence.
- United States: If you are a resident of the United States, disputes will be resolved through binding individual arbitration in accordance with the rules of the American Arbitration Association ("AAA"), except where prohibited by applicable state law. You and Exuma Secrets each waive the right to a jury trial and the right to participate in a class action, collective action, or representative proceeding. Claims in small claims court and claims for injunctive relief are excluded from arbitration. You may opt out of this arbitration agreement by sending written notice to support@exumasecrets.com within 30 days of first accepting this Agreement. You retain any rights under applicable state consumer protection statutes.
- Asia-Pacific: If you are a consumer in Japan, South Korea, Australia, Singapore, or another Asia-Pacific jurisdiction, you retain any mandatory rights under applicable local consumer protection and data privacy laws, and you may bring legal proceedings in the courts of your country of residence.
23. Apple & Google Platform Terms
If you downloaded the App from the Apple App Store, you acknowledge that:
- This Agreement is between you and Exuma Secrets, not Apple Inc. Apple has no obligation to furnish maintenance or support services for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims relating to the App, including product liability, consumer protection, or intellectual property infringement.
- Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce its terms.
If you downloaded the App from Google Play Store, you acknowledge that Google LLC has no obligations under this Agreement and is not responsible for the App or its content.
24. Severability
If any provision of this Agreement is found to be unenforceable or invalid under the laws of any jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
25. Entire Agreement
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Exuma Secrets regarding your use of the App and supersedes any prior agreements.
